Terms of Service

These Terms of Service ("Terms") govern your use of the SolidPing website (www.solidping.io) and any hosted services (collectively, the "Service") operated by:

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service​

SolidPing is an open-source distributed monitoring platform. The Service includes:

  • The SolidPing website and documentation
  • Any hosted or commercial offerings that may be made available in the future

2. Open-Source Software​

The SolidPing software is available as open source at github.com/fclairamb/solidping. Your use of the open-source software is governed solely by its license terms as specified in the repository. These Terms do not apply to your self-hosted use of the open-source software.

3. Acceptable Use​

When using the Service, you agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer any hosted components of the Service (this does not restrict rights granted by the open-source license)

4. Intellectual Property​

  • The SolidPing name, logo, and branding are proprietary to WEBINGENIA
  • The open-source software is licensed under its respective license
  • Website content, documentation, and design are the property of WEBINGENIA
  • User-generated data (monitoring configurations, check results) remains yours

5. Data and Privacy​

We are committed to protecting your privacy in accordance with the General Data Protection Regulation (EU 2016/679) and applicable French data protection law. Every data-protection document is indexed at Legal & GDPR.

  • Privacy Policy: The Privacy Policy describes what personal data the hosted service collects, on what legal basis, who it is shared with, how long it is kept, and your rights.
  • Data Processing Agreement: Where we process personal data on your behalf, we do so as your processor under the Data Processing Agreement, which is incorporated into these Terms by reference and takes effect without signature. It includes the Article 28 annexes and the EU Standard Contractual Clauses where transfers require them.
  • Sub-processors: The current list is published at Sub-processors. We give at least 30 days' notice before adding or replacing one, and you may object as set out in the DPA.
  • Security: The technical and organisational measures we apply are described at Security measures.
  • Your rights: Under the GDPR you may access, rectify, erase, restrict, object to, and port your personal data. Most of this is self-service; the process is at Your data: access, export, deletion.
  • Cookies: The website sets no cookies. The dashboard sets only strictly necessary cookies plus one interface preference; optional analytics may be refused. See the Cookie Policy.
  • Self-hosted use: When you run the open-source software yourself, no data reaches us and we are not your processor. See Self-hosting & GDPR.

6. Termination​

  • By you: You may stop using the Service at any time. If a hosted service with accounts is offered, you may request account deletion by contacting us.
  • By us: We may suspend or terminate your access to the Service at any time if you violate these Terms, with or without prior notice.
  • Effect of termination: Upon termination, your right to use the Service ceases. We will make reasonable efforts to allow you to export your data before deletion, unless termination is due to unlawful activity.

7. Disclaimer of Warranties​

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Monitoring results will be accurate or timely
  • The Service will meet your specific requirements

8. Limitation of Liability​

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEBINGENIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to your data
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or similar issues transmitted through the Service

9. Modifications​

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We may also update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

10. Governing Law and Jurisdiction​

These Terms are governed by the laws of France. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France.

11. Severability​

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
